What are his damages? No doubt the statement is false. But do you think a jury is going to be sympathetic to the guy who didn't personally post the n-word, but responded to a thread with that title like it was NBD? The distinction there entitles him to significant damages? You think the NYer will really be embarrassed by this type of error and want a quick settlement? Or do you think they would prefer to have out the fight, including extensive discovery into Charles's posting history, etc? Try to think like a normal person on a jury in DDC or SDNY. If I were Charles's lawyer, I'd advise him not to sue. Chances of significant recovery minimal. Meanwhile, suing would keep him in the press in an extremely unfavorable light and postpone (or permanently prevent) his ability to get past this episode in his life. He should be laying low, waiting for this to die down. Then he can re-emerge, repent, and probably find decent work based on his obvious talents. If he leans into this by suing news organizations, he'll be "the guy who posted racist shit online" forever and never get past it.

You have to prove damages by showing how your reputation changed as a result of the publication of the statement and how this led to lost income etc. The problem is that the falsehood here has virtually no impact on his reputation (already seen as an unemployable racist before publication of statement). The cost of litigation, going through discovery, and keeping his infamy in the public eye would be much worse than the nominal damages he might be able to get years later.

That's what makes me sad about this whole episode. Darcy wrote his article misleadingly in such a way as to make it seem to the casual reader that Charles wrote all the threads that he merely replied to. He did it it with very clear intention and purpose, trying to touch the line of slander without actually crossing it.
